Terms of service and participation waiver

By booking or participating in sessions with DMTA Pty Ltd ( ‘De Marzi Tennis Academy’ or ‘DMTA’) you acknowledge and agree to the following terms:

1. Assumption of Risk

Tennis involves physical activity. Injuries, falls, or property damage may occur. You participate at your own risk.

2. Medical & Fitness

You confirm you are medically fit to participate and will disclose any relevant health conditions, injuries, or limitations. Coaches may modify activities or decline participation if safety is at risk.

3. Supervision

Children under 18 must be supervised by a parent or guardian unless prior arrangements are made with DMTA.

4. Liability

DMTA, its coaches, employees, and agents are not liable for injury, loss, or damage arising from participation, except in cases of gross negligence or wilful misconduct. DMTA does not accept liability for property damage at private residences, rented courts, or other locations.

5. Conduct & Safety

  • General Behaviour: Participants must follow coaches’ instructions and behave respectfully. Disruptive or unsafe behaviour may result in termination of sessions without refund.

  • Late Arrivals: Sessions will commence and conclude at the scheduled times. If a participant arrives late, the session will not be extended. If a participant is late for more than 50% of the scheduled lesson duration without prior notice, the coach may deem the session forfeited and non-creditable.

6. Cancellation & Credit Policy

  • Private Sessions: Cancellations must be made at least 24 hours before the scheduled session. If cancelled with sufficient notice, the session will be converted into a credit. Sessions cancelled with less than 24 hours’ notice are non-refundable and non-creditable.

  • Semi-Private Bookings: Semi-private lessons are purchased as a complete package. Sessions are debited from the package regardless of individual attendance. A session will only be credited or rescheduled if all participants cancel with at least 24 hours’ notice. If one participant attends and the other does not, the session is debited for both parties.

  • Squad Sessions: Squads are booked on a term or block basis. No credits or refunds are provided for missed sessions due to personal reasons, illness, or travel. Credits for squads will only be issued in the event of a "washout" (session cancelled by DMTA due to inclement weather) or if DMTA cancels the session for administrative reasons.

  • Washouts: The determination of whether a session is cancelled due to weather (a 'washout') is at the sole discretion of the DMTA coach. Decisions are typically made 30–60 minutes prior to the session start time. If a coach declares a washout, all affected participants will be issued a session credit. If a session is more than 50% completed before being rained out, it is considered a full session and no credit will be issued.

  • Expiry: All credits expire 6 months from the date of issue. Sessions cancelled with less than 24 hours’ notice are non-refundable and non-creditable.

7. Payment Terms

Payments are due per session, block, or program as invoiced. For semi-private bookings and Squad fees, payment is required promptly upon receipt of invoice to secure the booking for the remainder of the term or block. DMTA reserves the right to suspend participation if invoices remain unpaid beyond their due date. DMTA further reserves the right to reschedule sessions due to coach availability, weather, or unforeseen circumstances. DMTA reserves the right to review and adjust fees periodically. Participants will be provided with at least 30 days’ notice of any price changes.

8. Photography & Media

DMTA may take photos or videos during sessions for promotional purposes. Consent will be sought where possible, and refusal will be respected.

9. Privacy

Personal information collected by DMTA will be used only for coaching, administration, and communication purposes in accordance with the Privacy Act 1988 (Cth) and Australian Privacy Principles (APPs).

10. Independent Operation

DMTA and its coaches operate independently and are not affiliated with any other tennis club or academy. Any marketing or advertising by DMTA is general in nature and directed to the public, not to specific players or members of other organisations. Players and parents choose to participate in DMTA programs voluntarily and on their own initiative. DMTA does not solicit or induce players or staff to leave other clubs or academies.

11. Future Locations

These terms apply to sessions conducted at private homes, rented courts, or any future DMTA facilities. Participants acknowledge that DMTA may update safety procedures as facilities are introduced.

By booking or attending a session, you confirm that you have read, understood, and agree to these Terms of Service & Participation Waiver.
